BY ENTERING WILD BULL PREMISES, PRESENTING ID FOR ENTRY, PURCHASING TICKETS OR SERVICES, USING THE WILD BULL WEBSITE, OR REMAINING ONSITE, YOU AGREE TO THESE TERMS.

IMPORTANT MICHIGAN NOTICE (Alcohol Service / Dram Shop)

Nothing in these Terms waives, limits, or replaces rights and obligations created by Michigan law regarding the sale, furnishing, or giving of alcoholic liquor, including the Michigan Liquor Control Code and Michigan dram shop provisions. See Section 11 for full Dram Shop Act notice.

  8. 8. ENTRY IS A PRIVILEGE — We may refuse or revoke entry for safety, conduct violations, or business reasons.

  10. 10. ALL SALES FINAL — Tickets and cover charges are non-refundable.
  11. 11. CRIMINAL INCIDENTS — POLICE REPORTS ENCOURAGED — If a crime occurred (assault, drugging, etc.), filing a police report helps everyone. See Section 12.
  12. 12. CONFIDENTIAL DISPUTE RESOLUTION — Disputes are resolved confidentially. See Section 13.
  13. 13. HONEST REVIEWS WELCOME — We respect your right to post honest reviews under the Consumer Review Fairness Act. See Section 15.
  14. 14. CLAIMS DEADLINES — General claims: 1 year (except where statute requires longer). Dram Shop claims: 2 years (statutory). See Section 12.

PART A: AGREEMENT, ENTRY, CONDUCT & PRIVACY

SECTION 1. ACCEPTANCE & AGREEMENT

1.1 Active Assent — In Person

By presenting your ID for scanning or verification at entry, you expressly acknowledge and accept these Terms. If you do not agree, do not enter.

1.2 Active Assent — Online

By clicking "I Accept," "I Agree," "Submit," or any similar button or checkbox when purchasing tickets, making reservations, or accessing Wild Bull's website or mobile applications, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not complete the transaction or use the website.

1.3 Notice & Availability

These Terms are posted at the venue entrance and at wildbull.club/terms-of-use. You acknowledge you have had a reasonable opportunity to review them before entering or completing any online transaction.

1.4 Modifications

We may update these Terms by posting new versions. Changes do not apply retroactively.

1.5 Definitions

"Wild Bull" means Wild Bull, LLC and its Affiliates.

"Affiliate" includes any entity controlling, controlled by, or under common control with Wild Bull, LLC.

Affiliates are intended third-party beneficiaries with full enforcement rights.

SECTION 2. AGE RESTRICTIONS

Wild Bull is a 21+ venue after 9 p.m. Valid government-issued photo ID is required for alcohol purchases and may be required for entry at any time.

SECTION 3. ADMISSION & TICKETING

3.1 All Sales Final

Admission fees, cover charges, and tickets are non-refundable.

3.2 Refusal of Entry

Management reserves the right to refuse entry for any reason consistent with law, including dress code violations, intoxication, or capacity limits.

3.3 Payment Reversal

Patrons agree not to reverse or charge back payments. Returned payments incur administrative fees.

3.4 Cashless Transactions

Wild Bull operates cashless. Payments must be made via credit/debit card or contactless methods (e.g., Apple Pay).

3.5 Special Events & Private Rentals

Certain nights may be designated as special events requiring special tickets or surcharges. Special event tickets remain subject to these Terms unless otherwise stated at purchase.

Private Events: Private rentals require a separate written agreement. Payments are non-refundable. A $1,000 damage deposit is required. Clients must use approved vendors and obtain liability insurance (minimum $1M per occurrence / $2M aggregate). Hosts must ensure guests comply with these Terms.

SECTION 4. PATRON CONDUCT

4.1 Compliance

Guests must cooperate with staff and security at all times. Aggressive, harassing, threatening, or illegal behavior results in ejection without refund.

4.2 Dress Code & Hygiene

Stylish attire is required. The following are not permitted:

  • Athletic wear (sweatpants, gym shorts)
  • Excessively worn or dirty clothing
  • Inadequate hygiene

4.3 Prohibited Items

  • Weapons
  • Illegal substances
  • Outside beverages
  • Fireworks or dangerous items
  • Large bags and backpacks
  • Animals (except ADA-recognized service animals)

4.4 Professional Recording Devices

Professional cameras or recording devices are not allowed. Personal cell-phone cameras are permitted subject to Section 5.

4.5 Lost & Found

Wild Bull is not responsible for lost, stolen, or damaged items. Found items are held at the host stand for a limited time.

SECTION 5. MEDIA, SURVEILLANCE & PRIVACY

5.1 Professional Recording Prohibited

Professional photography, video, or audio recording in the venue is prohibited without prior written consent.

5.2 Personal Cell-Phone Photos

Personal cell-phone photos are allowed provided they do not disrupt other guests or violate law.

5.3 No Unauthorized Recording of Staff

Recording staff or security personnel in a manner that interferes with their duties, violates law, or violates reasonable venue rules may result in removal.

5.4 Media Release

By entering, you grant Wild Bull the right to use your image, likeness, and voice in any media for advertising or promotional purposes without compensation, except where prohibited by law.

5.5 Surveillance

Public areas may be monitored by video and/or audio surveillance for safety and security, excluding restrooms. See Section 8 for surveillance preservation policies.

5.6 Data Collection & Use

By using our services, you consent to the collection of personal data necessary for transactions and security. Data may be used for marketing, security, analytics, customer service, and compliance with legal obligations. We do not sell personal data to third parties. We may share information with trusted vendors (e.g., payment processors, marketing services) who are contractually obligated to safeguard personal data.

5.7 Cookies

Our website uses cookies and similar technologies to improve functionality and analyze usage patterns.

SECTION 6. ENTRY RESTRICTIONS & REINSTATEMENT

6.1 Private Establishment

Wild Bull is a private establishment. Admission is a revocable privilege, not a right. Management reserves the absolute right to restrict, suspend, or permanently revoke entry privileges for conduct that violates these Terms, threatens safety, or harms Wild Bull's business interests.

6.2 Grounds for Permanent Restriction (No Reinstatement)

  • Violence or assault
  • Weapons violations
  • Sexual assault or misconduct
  • Drug distribution
  • Credible threats against staff

6.3 Grounds for Long-Term Restriction (Minimum 1 Year; Reinstatement by Application)

  • Theft or property damage
  • Drug possession or use
  • Coordinated harassment
  • Fraud or identity misrepresentation including fake IDs

6.4 Grounds for Short-Term Restriction (30-180 Days; Automatic Expiration)

  • Excessive intoxication or ejection
  • Disorderly conduct
  • Policy violations after warning
  • Trespass after removal
  • Underage entry attempt

6.5 Reinstatement Process

Short-term restrictions expire automatically.

Long-term restrictions: Individuals may apply for reinstatement after one year by submitting a written request to the address in Section 19, including:

  • Full legal name and date of birth
  • Approximate date and nature of the incident
  • Acknowledgment of conduct
  • For theft: proof of restitution

Wild Bull will review requests within 30 days. Reinstatement is not guaranteed and may include conditions (e.g., probationary period).

Permanent restrictions: No reinstatement available.

6.6 Appeals

Individuals may submit a written appeal within 60 days of restriction. Wild Bull will respond within 30 days. The decision on appeal is final. Wild Bull is not required to disclose specific evidence except as required by law.

PART B: ALCOHOL SERVICE & DOCUMENTATION

SECTION 7. RESPONSIBLE ALCOHOL SERVICE POLICY

7.1 Service Prohibitions

Wild Bull will not sell, furnish, or give alcoholic liquor to:

  • Any minor, or
  • Any person who is visibly intoxicated

Wild Bull may refuse service, stop service, and/or remove a guest from the premises to promote safety and compliance with Michigan law. (See MCL 436.1801(1).)

7.2 Visible Intoxication Defined

Intoxication apparent through observable behavior and physical signs, including:

  • Slurred, incoherent, or unusually loud speech
  • Stumbling, swaying, loss of balance, difficulty walking, or falling
  • Bloodshot/glassy eyes, inability to focus, delayed reactions
  • Poor coordination (dropping items, spilling drinks, fumbling)
  • Aggressive, belligerent, disruptive, or unusually impulsive behavior
  • Confusion, disorientation, or impaired judgment

7.3 Mandatory Service Refusal Protocol

When staff observe signs suggesting visible intoxication, Wild Bull staff will:

  1. Stop alcohol service to that guest
  2. Notify a manager or supervisor on duty
  3. Document the observation and action taken
  4. Offer non-alcoholic alternatives and encourage food consumption
  5. Encourage safe transportation (rideshare/taxi) and may assist in placing a ride request
  6. If needed for safety, request the guest to leave and/or contact law enforcement or medical assistance

7.4 ID Procedures & Statutory Defense

Wild Bull will refuse service and/or entry if:

  • An ID appears altered, invalid, or does not match the person presenting it
  • The person refuses to present ID
  • The person is suspected of being underage

Michigan law provides a defense in certain circumstances where a retail licensee demanded and was shown a Michigan driver license or official state personal identification card that appeared genuine and showed the person was at least 21 years of age. (See MCL 436.1801(6).)

7.5 Responsible Business Practices

Wild Bull maintains "responsible business practices" as described in Michigan law (MCL 436.1815), including:

  • Server training certification (TIPS/ServSafe)
  • ID verification protocols
  • Documented policies against serving visibly intoxicated persons
  • Incident logging procedures

7.6 Patron Rules Regarding Alcohol

Patrons must not purchase, provide, or furnish alcohol to minors or to any person who appears visibly intoxicated. Violations may result in:

  • Refusal of service
  • Ejection without refund
  • Referral to law enforcement

SECTION 8. INCIDENT DOCUMENTATION & EVIDENCE PRESERVATION

8.1 Mandatory Incident Logging

Wild Bull staff are required to document:

  • Service refusals/service stoppage due to suspected visible intoxication (time, location, observable behaviors, staff involved, manager notified, actions taken)
  • ID-related refusals, suspected fake IDs, or attempted underage purchases
  • Altercations, injuries, medical emergencies, or police involvement

8.2 Video Surveillance & Preservation

Wild Bull uses video and/or audio surveillance in public areas (excluding restrooms) for safety and security. When an incident is documented or when Wild Bull receives written notice of a potential claim reasonably identifying date/time/location, Wild Bull will make reasonable efforts to preserve relevant surveillance footage for a minimum of 3 years, subject to lawful access, retention system capabilities, and legal requirements.

Surveillance footage not identified for preservation may be overwritten or deleted in the ordinary course of operations. Surveillance is not guaranteed to be monitored in real time and is not a substitute for emergency services. If you need immediate help, contact staff and/or call 911.

8.3 Preservation Requests

To request preservation or provide notice of an incident, send written notice including:

  • Date
  • Approximate time
  • Location
  • Description of the incident

Email notice may be sent to info@wildbull.club, but certified mail is recommended for legal notices.

8.4 Mutual Evidence Preservation

Wild Bull will follow the protocols above. You should preserve relevant evidence in your possession or control (photos, videos, clothing, communications, medical records). Destruction of evidence by either party may have legal consequences.

PART C: RISKS, LIABILITY & ACTIVITIES

SECTION 9. RISK ASSUMPTION & LIABILITY

9.1 Inherent Risks

You voluntarily assume all risks associated with nightlife activities, including but not limited to:

  • Wet floors and spilled beverages
  • Broken glass and debris
  • Crowded conditions and physical contact
  • Loud music
  • Strobe and laser lighting
  • Intoxicated patrons
  • Mechanical bull injuries (see Section 10)
  • Parking-lot hazards

9.2 Health Representation

You affirm you are healthy and free of conditions making participation unsafe.

9.3 Waiver of Ordinary Negligence

TO THE MAXIMUM EXTENT PERMITTED BY LAW, you release Wild Bull from liability for ordinary negligence arising from premises conditions or operation, including without limitation:

  • Slip and fall incidents
  • Spilled beverages and wet floors
  • Broken glass
  • Crowding
  • Low lighting conditions
  • Equipment or furnishings
  • Sound levels
  • Security incidents
  • Similar premises-related occurrences

9.4 What This Waiver Does NOT Cover

This waiver does NOT apply to:

  • Gross negligence
  • Willful misconduct
  • Statutory liability under the Michigan Liquor Control Code (see Section 11)

9.5 No Waiver of Michigan Dram Shop Rights

This Section does not waive or limit any claim, defense, right, or remedy under MCL 436.1801 or other non-waivable statutory rights. See Section 11.

9.6 Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Wild Bull from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your unlawful acts
  • Your violation of these Terms
  • Your intentional misconduct
  • Your negligence that causes injury to another person or damage to property

This agreement does not limit any statutory right a retail licensee may have under Michigan law, including the right to seek indemnification from an alleged visibly intoxicated person where applicable under MCL 436.1801(5).

SECTION 10. MECHANICAL BULL

10.1 Inherent Risks

Riding the mechanical bull involves significant inherent risks of physical injury including but not limited to:

  • Falls and impacts
  • Sprains and fractures
  • Concussions
  • Neck and back injuries
  • Other serious bodily harm

BY CHOOSING TO RIDE, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY OR DEATH associated with mechanical bull activities.

10.2 Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, you release and hold harmless Wild Bull from all liability for injuries sustained while riding the mechanical bull, except for injuries caused by Wild Bull's gross negligence or willful misconduct.

10.3 Eligibility

Riders must be:

  • At least 21 years of age
  • Sober (no alcohol or drug impairment)
  • Free of health conditions that could be aggravated by the activity (including heart conditions, back or neck problems, pregnancy, or recent surgeries)

Wild Bull may deny rides at its sole discretion for safety reasons.

10.4 Operational Rules

Riders must:

  • Follow all staff instructions
  • Remove loose items (jewelry, glasses, hats)
  • Secure long hair

Wild Bull controls bull speed and duration and may stop the ride at any time.

PART D: DISPUTES & LEGAL

SECTION 11. MICHIGAN DRAM SHOP ACT NOTICE (MCL 436.1801)

This Section summarizes key provisions of Michigan law. For the full statutory text, see Section 20.

11.1 Exclusive Remedy

Michigan law provides that dram shop claims against a licensee are governed by statute and are the exclusive remedy for money damages against a licensee arising out of the selling, giving, or furnishing of alcoholic liquor to a minor or intoxicated person. (MCL 436.1801(9))

11.2 Two-Year Limitations Period

"An action under this section must be instituted within 2 years after the injury or death." (MCL 436.1801(3))

11.3 120-Day Written Notice Requirement

"A plaintiff seeking damages under this section shall give written notice to all defendants within 120 days after entering an attorney-client relationship for the purpose of pursuing a claim under this section." (MCL 436.1801(3))

11.4 Name and Retain Requirement

A dram shop action against a retail licensee must not be commenced unless the minor or alleged intoxicated person is named as a defendant and retained until the litigation is concluded by trial or settlement. (MCL 436.1801(4))

11.5 Indemnification from Intoxicated Person

Michigan law provides that a licensee has a right to full indemnification from the alleged visibly intoxicated person for damages awarded against the licensee. (MCL 436.1801(5))

11.6 Defenses & ID Defense

Michigan law provides that defenses of the alleged visibly intoxicated person or the minor are available to the licensee, and provides a statutory defense in certain underage-sale circumstances involving apparent valid Michigan ID. (MCL 436.1801(6))

11.7 Rebuttable Presumption

A retail licensee other than the retail licensee who last sold, gave, or furnished alcoholic liquor to the minor or visibly intoxicated person has a rebuttable presumption of no liability. (MCL 436.1801(7))

11.8 Responsible Business Practices Defense

Wild Bull maintains responsible business practices pursuant to MCL 436.1815, including server training certification, ID verification protocols, documented policies against serving visibly intoxicated persons, and incident logging procedures.

SECTION 12. CLAIMS PROCEDURE & PRE-CLAIM TIMELINE

12.1 Pre-Claim Timeline (Required Steps)

BEFORE YOU FILE A CLAIM — REQUIRED STEPS

  1. WRITTEN NOTICE — Send to Wild Bull within 60 days of incident. Include: name, contact info, date/time/location, description, relief sought
  2. CURE PERIOD — Wait 60 days (monetary claims) or 90 days (non-monetary claims). Wild Bull investigates and responds
  3. INFORMAL DISCUSSION — 30 days of good-faith discussions
  4. MEDIATION (if unresolved) — See Section 13.7
  5. ARBITRATION (if still unresolved) — See Section 13.11

SKIPPING ANY STEP = Fee-shifting + costs (see Section 13.33)

12.2 Limitations Periods

  • General claims: 1 year from accrual (except where statute requires longer)
  • Dram Shop claims: 2 years from injury/death (MCL 436.1801(3))

12.3 Dram Shop Claims — Statutory Requirements Preserved

Nothing in this Section shortens, expands, or replaces any statutory requirement under MCL 436.1801, including the 2-year limitations period and the 120-day written notice requirement.

12.4 Statutory / Non-Waivable Claims

Nothing in these Terms waives or limits rights or obligations that cannot be waived by contract, including specific alcohol-liability claims under Michigan law. Wild Bull reserves all statutory defenses, including those under MCL 436.1815.

12.5 Criminal Allegations — Police Reports Encouraged

If your claim involves alleged criminal conduct (including but not limited to assault, battery, drink tampering/drugging, sexual assault, theft, or any other criminal act), we strongly encourage you to file a police report with the appropriate law enforcement agency. We understand that trauma victims may need additional time.

Wild Bull's Commitment: If a police report is filed, Wild Bull will fully cooperate with law enforcement, including providing surveillance footage, witness statements, and other relevant evidence to investigating officers.

12.6 Third-Party Identification

If your claim involves a third party (another patron) who you believe caused you harm, we ask you to:

  1. Provide any identifying information you have (name, physical description, how you came to be in contact with them)
  2. Share any evidence in your possession identifying the third party (photos, videos, text messages)
  3. Cooperate with Wild Bull's review of surveillance footage to assist in identification

Wild Bull's Cooperation: We will assist in identification efforts by reviewing surveillance and providing relevant information through the confidential ADR process.

12.7 Medical Evidence for Drugging/Intoxication Claims

If you believe you were involuntarily drugged or that a substance was placed in your drink without your knowledge, we strongly encourage you to:

  1. Seek immediate medical attention — Go to an emergency room or urgent care as soon as possible
  2. Request toxicology testing — Ask for blood and urine screens for common substances (GHB, Rohypnol, Ketamine)
  3. Preserve medical records — Obtain and preserve all medical records related to the incident
  4. Consider filing a police report — See Section 12.5 above

Important: Common date-rape drugs clear the body quickly. Prompt testing improves detection.

12.8 Statement Accuracy

We encourage you to provide the most accurate information you can at the time of reporting. Honest mistakes in recall are normal and understandable—memory can be affected by stress, trauma, and the passage of time.

12.9 Cooperation with Investigation

By entering Wild Bull and agreeing to these Terms, you agree to cooperate in good faith with any Wild Bull investigation of an incident you report, including:

  • Providing a written statement within 14 days of request
  • Identifying witnesses known to you
  • Providing relevant photos, videos, or communications in your possession
  • Attending a recorded interview (in person or via video) if requested

Wild Bull's Reciprocal Obligation: Wild Bull agrees to preserve evidence pursuant to Section 8 and to make relevant, non-privileged information available through the confidential mediation process.

SECTION 13. ALTERNATIVE DISPUTE RESOLUTION

WARNING: THIS SECTION AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

KEY DEADLINES AT A GLANCE:

  • Opt-out: 30 days from first visit
  • Informal discussion: 30 days
  • Mediation response: 30 days (+ 30 days if no response)
  • Arbitration response: 45 days (+ 30 days if no response)

PART A: SCOPE & WAIVERS

13.1 Scope & Exclusions

This Section applies to all disputes arising from your visit, ticket purchase, or interaction with Wild Bull, EXCEPT:

  • Claims governed by the Michigan Dram Shop Act (MCL 436.1801)
  • Small claims court matters within jurisdictional limits (either party may elect small claims)
  • Claims for gross negligence or intentional misconduct
  • Claims by third parties not bound by these Terms
  • Claims where arbitration is prohibited by law

Small Claims Preserved: Nothing in these Terms prevents either party from pursuing claims in small claims court if the claim falls within that court's jurisdictional limits.

13.2 Right to Opt Out

You may opt out of this arbitration provision by sending written notice to our address (Section 19) within 30 days of your first visit. Opting out does not affect any other provisions of these Terms.

13.3 Waiver of Jury Trial

YOU WAIVE THE RIGHT TO A JURY TRIAL FOR COVERED DISPUTES.

13.4 Class Action Waiver

YOU AGREE THAT ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

If this waiver is unenforceable as to a particular claim, that claim shall be severed and may proceed in court while all other claims proceed in arbitration.

Additional subsections 13.5 through 13.33 detail the complete ADR process including informal discussion periods, mediation initiation and procedures, arbitration requirements, hearing procedures, confidentiality requirements, court proceedings, and penalty schedules. All remedies apply equally to both parties.

SECTION 14. LIMITATION OF LIABILITY & DAMAGES

14.1 Cap on Liability

Wild Bull's total liability is limited to the greater of $100 or the admission fee, except:

  • For gross negligence or intentional misconduct
  • Where such limitation is prohibited by law (including liability governed by MCL 436.1801)

14.2 No Punitive or Consequential Damages

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Wild Bull is not liable for punitive, special, incidental, consequential, or indirect damages
  • Neither party shall be liable for lost profits or emotional distress damages
  • You waive any right to seek punitive, exemplary, or treble damages

SECTION 15. CONSUMER REVIEWS & CRFA COMPLIANCE

15.1 Your Right to Post Reviews

Wild Bull respects your legal right under the Consumer Review Fairness Act (15 U.S.C. Section 45b) to post honest reviews, including negative feedback. We do not restrict, penalize, or condition entry upon the content of truthful consumer reviews.

15.2 False Statements & Defamation

Consistent with CRFA Section 45b(b)(2)(B)-(C), posting content that constitutes defamation (false statements of fact presented as truth and causing reputational harm) or is clearly false or misleading is a breach of these Terms.

15.3 What This Means

PROTECTED (Opinions & Criticism):

  • "I didn't enjoy my visit."
  • "The drinks were overpriced."
  • "The music was too loud for me."
  • "I felt unsafe."
  • "Service was slow."

NOT PROTECTED (False Statements):

  • "They serve alcohol to minors." (when false)
  • "The health inspector shut them down." (when false)
  • "Staff assaulted a customer." (when fabricated)
  • "They drugged my drink." (when unsubstantiated)
  • "The staff sells drugs." (when false)

SECTION 16. CONFIDENTIALITY & TRADE SECRETS

16.1 Definition

Confidential Information includes non-public business methods, security protocols, and marketing strategies.

16.2 Non-Disclosure

Patrons may not solicit, use, or disclose Wild Bull's Confidential Information. Violations may result in injunctive relief and damages.

SECTION 17. STANDARD PROVISIONS

17.1 Severability

If any word, phrase, or provision is invalid or unenforceable, it will be modified or severed only as necessary to make it enforceable. All other provisions remain in effect.

17.2 Survival & Entire Agreement

Provisions regarding confidentiality, indemnification, liability limits, fee-shifting, and evidence preservation survive termination. These Terms take precedence over conflicting terms in referenced documents. These Terms constitute the entire agreement; amendments must be in writing and signed by both parties.

17.3 Non-Waiver

Wild Bull's failure to enforce any provision of these Terms, or delay in doing so, does not constitute a waiver of that provision or any other rights. Any waiver must be in writing and signed by an authorized representative of Wild Bull. Wild Bull retains all rights and remedies under these Terms and applicable law.

17.4 Prohibition on Assignment, Subrogation & Litigation Funding

No Assignment of Claims: To the fullest extent permitted by Michigan law, you may NOT assign, delegate, sell, or transfer any rights, claims, or causes of action arising from these Terms or your visit to any third party, including litigation funding companies, class action law firms, or collection agencies. Any attempted assignment without Wild Bull's prior written consent is null and void.

Wild Bull's Assignment Right: Wild Bull may assign this agreement in connection with a sale, merger, or reorganization.

No Subrogation: No third party, including insurers or health care providers, shall have any right of subrogation against Wild Bull arising from any claim you may have. You agree to waive any subrogation rights of your insurers and to indemnify Wild Bull against subrogation claims.

Litigation Funding Disclosure: If you receive financial assistance from a litigation funding company, you must disclose this to Wild Bull in writing within 14 days.

17.5 No Third-Party Beneficiaries

These Terms are intended solely for the benefit of you (the patron) and Wild Bull and its Affiliates. Nothing confers rights on any third party, including family members, employers, or advocacy groups.

Derivative Claims: Claims for loss of consortium or other derivative claims by persons not party to these Terms must be brought through the ADR process.

17.6 Defense of Proceedings

Wild Bull reserves all defenses available under these Terms and applicable law, including the right to assert non-compliance with ADR requirements in response to any claim.

Service Requirements: Legal process must be served on Wild Bull's registered agent at the address in Section 19, via personal service or certified mail, with a copy to legal@wildbull.club.

SECTION 18. FORCE MAJEURE

No refunds for closures due to events beyond our control, including:

  • Power outages
  • Government orders
  • Pandemics
  • Acts of God

We may implement health protocols (masking, vaccinations, capacity limits) and adjust operating hours accordingly.
